Payments, Refunds and Cancellations

Payment Terms​

  1. GlobalShaala will be entitled to a platform facilitation fee (“Service Fee”), as defined in Annexure A of the Terms of Service. The terms of the payment structure envisaged herein shall be read in consonance with the structure delineated on the Website. For clarification of doubt, at all times, the terms of this Agreement shall supersede and prevail.

  2. The payment collected by the Company from the End-User/s shall be settled on the 15th of every month. The Company shall remit the fees paid by the End-User/s to You on monthly basis after deducting the Service Fee and all applicable taxes.

  3. Even at the instance of any promotional discount provided by GlobalShaala, GlobalShaala shall appropriately raise invoice on the End-User and shall reimburse the Mentor for the difference, if any.

  4. GlobalShaala reserves the right to amend the service fee, pricing, pricing bands, or structure in any transaction that falls within the purview of this Agreement from time to time for any reason whatsoever, subject to due notification of such amendment to the Mentor (direct notification or via GlobalShaala’s Website) and the Mentor specifically disclaims any and all rights that vest upon him/her under any contract, law or equity in this regard.

  5. Notwithstanding anything contained herein, the Mentor understands, agrees, affirms and acknowledges that the fees paid to the Mentor shall be the full and complete settlement for any and all services envisaged under this Agreement.

Cancellation, Rescheduling and Refund Policy

Notwithstanding anything contained in this Agreement or otherwise, the Mentor shall not be entitled to any payment or compensation for any workshop or Course of whatsoever nature, wherein a refund was provided by GlobalShaala to the End-User for that  workshop or course in accordance with the refundable events as specified herein below:

 

  1. Cancellation, Rescheduling and Refund Policy for Workshops

    1. The End-User and/or his/her parent want to cancel the workshop booked:

      1. If the workshop is cancelled before 00:00 AM on the day before the day of workshop, full refund will be offered.

      2. If the workshop is cancelled at or after 00:00 AM on the day before the day of workshop, no refund will be offered;

    2. ​​The Mentor wants to cancel the workshop any time prior to the start of the :
      1. In scenarios where the Mentor wants to cancel an workshop, the End-User must be given prior notice at least forty-eight (48) hours before the commencement of the scheduled workshop and the End-User and his/her parent will receive full refund for that particular workshop.
    3. ​​The Mentor wants to reschedule the workshop any time prior to the start of the workshop:
      1. In scenarios where the Mentor wants to reschedule a workshop, the End-User must be given prior notice at least forty-eight (48) hours before the commencement of the scheduled workshop and the End-User and his/her parent will receive full refund for that particular workshop if the End-User chooses to not attend the rescheduled workshop.
    4. ​​The End-User and/or his/her parent wants to request a refund within forty-eight (48) hours post the workshop:
      1. End-User and/or his/her parent may raise potential issues with the Mentor via the platform and expect a refund up to 100% for the workshop. For the purpose of this sub-clause (4) of Clause (12), the refund will only be initiated post completion of preliminary investigation on the potential issues raised by the End-User and/or his/her parent. In cases where the parent of the End-User is not satisfied with the services provided by the Mentor, full refunds will be considered on a case-to-case basis. However, a detailed inquiry will be conducted by the GlobalShaala and Our decision on the same shall be final and binding.
      2. In all other cases such as internet issues or the End-User is unable to make time for the workshop, no refund will be given, since the End-User will be receiving the recording of the complete workshop on the platform.
      3. If no End-User attends a workshop 15 minutes after the start of the scheduled workshop, then the Mentor may end the class. No refund will be offered to the End-Users. A recent recording of the workshop will be made available to the End-users upon request.
    5. ​If the Mentor cancels an ongoing workshop in case of an extreme unforeseen circumstance, the End-User and his/her parent will receive a full refund for that particular workshop.
    6. The Mentor may request the End-User to transfer to another workshop slot at least forty-eight (48) hours before the commencement of the scheduled workshop. If the End-User and/or his/her parent disagrees, the Mentor may choose to continue with the scheduled workshop or request to cancel the workshop.

      For the purpose of this sub-clauses (2) and (3) of Clause (12.1), if the Mentor fails to provide prior notice at least forty-eight (48) hours before the commencement of the scheduled workshop, GlobalShaala may take stringent action including but not limited to termination. The termination as a remedy shall be in addition to every other remedy made available to GlobalShaala under this Agreement or otherwise. The election of any one or more of such remedies by GlobalShaala shall not constitute a waiver by it of the right to pursue any other available remedy.

       
  2. Cancellation, Rescheduling and Refund Policy for Courses

    1. The End-User and/or his/her parent wants to cancel the entire Course before the Course commences:

      1. If the Course is cancelled before 00:00 AM on the day before the day of Course commencement, full refund will be offered.

      2. If the Course is cancelled at or after 00:00 AM on the day before the day of Course commencement, no refund will be offered.

    2. ​​If the mentor wants to cancel the entire Course before the Course commences:
      1. In scenarios where the Mentor wants to cancel an entire Course, the End-User must be given prior notice at least forty-eight (48) hours before the commencement of the scheduled Course and the End-User and his/her parent will receive a full refund for that particular Course.
    3. ​​The End-User and/or his/her parent wants to cancel the Course after the commencement of the Course:
      1. In such scenarios, GlobalShaala will refund the amount equal to the fee proportionate to the remaining classes of the Course.
    4. ​​The Mentor wants to cancel the Course classes after the commencement of the Course:
      1. In scenarios where the Mentor wants to cancel the Course after the commencement of the Course, the End-User must be given prior notice at least forty-eight (48) hours before the commencement of the next scheduled class and the End-User and his/her parent will receive a refund the amount equal to the fee proportionate to the remaining classes of the Course.
    5. ​​If the mentor wants to reschedule the entire Course before the Course commences:
      1. In scenarios where the Mentor wants to reschedule the Course classes, the End-User must be given prior notice at least forty-eight (48) hours before the commencement of the scheduled Course and the End-User and his/her parent will receive full refund for that particular Course if the End-User chooses to not attend the rescheduled Course.
    6. ​​The Mentor wants to reschedule the Course classes after the commencement of the Course:
      1. In scenarios where the Mentor wants to reschedule the Course classes after the commencement of the Course, the End-User must be given prior notice at least forty-eight (48) hours before the commencement of the scheduled Course and the End-User and his/her parent will receive a refund of the amount equal to the fee proportionate to the remaining classes of the Course if the End-User chooses to not attend the rescheduled Course classes.
    7. The Mentor may request the End-User to transfer to another batch or slot after the classes have commenced by providing notice at least forty-eight (48) hours before the commencement of the next scheduled Class of the course. If the End-User and his/her parent disagrees, the Mentor may choose to continue with the scheduled Course classes or request to cancel the remaining Course classes.

    8. The End-User and/or his/her parent is requesting a refund midway through the course:

      1. Only in cases where parent of the End-User is not satisfied with the services provided by the Mentor, a refund for the complete course will be considered on a case-to-case basis. However, a detailed inquiry will be conducted by the GlobalShaala and Our decision on the same shall be final and binding. No refund can be requested once the course is complete.

      2. In all other cases such as internet issues or the End-User is unable to make time for the Course, no refunds will be given, since the End-User will be receiving the recording of the complete Course on the platform.

      3. If no End-User attends a class 15 minutes after the start of the scheduled class, then the Mentor may end the class. No refund will be offered to the End-Users for that class. A recent recording of the class will be made available to the End-users upon request.

    9. In case no booked user shows up for a class, the mentor can wait for 15 minutes post the start time of the workshop, after which the class can be closed. No refunds are made to the users.

For the purposes of this clause 12, the following terms shall have the meanings assigned to them herein below:

 

“Online Workshop or Workshop” shall mean one class or one session scheduled to be taken by the Mentor and a notice of which is duly delivered to the End-User or his/her parent in advance.

 

“Online Course or Course” shall mean a series of Online Workshops (generally 03 – 30 classes).

 

Notwithstanding anything contained under this Agreement, the End-User shall not have any right to make any claims of whatsoever nature against GlobalShaala after expiry of forty-eight (48) hours from the date of consumption of the video workshop/services on the platform/application.

 

For the purpose of this sub-clauses (2), (4), (5) and (6) of Clause (12.2), if the Mentor fails to provide prior notice at least forty-eight (48) hours before the commencement of the scheduled Course or Course classes, GlobalShaala may take stringent action up to but not limited to termination. The termination as a remedy shall be in addition to every other remedy made available to GlobalShaala under this Agreement or otherwise. The election of any one or more of such remedies by GlobalShaala shall not constitute a waiver by it of the right to pursue any other available remedy.
